For example, my trademark clearance search process involves more than just exact-match searches. We look for:

  • Exact-match and similar trademarks that are already registered in the US
  • Exact-match and similar trademarks that are registered in major countries worldwide
  • Unregistered trademarks being used on Steam, mobile app stores, and sites like Board Game Geek (for game trademarks)

Preparing and Submitting Your Application

Once you’ve determined that your logo is unique, you can begin preparing your trademark application.

In the United States, you’ll need to submit your application to the USPTO, which requires the following information:

  • A clear representation of your logo, such as a high-resolution image file;

Once your logo is registered, you’ll need to maintain the trademark through periodic maintenance filings and paying the required fees to keep your registration active. You also need to actually be using the trademark – if you stop, it will be abandoned and you will lose your rights.
